Habitual Drunk Driver Receives 15 Year Prison Term
After Judge David R. Cashman learned that defendant Richard Anthony Caporal had been convicted of drunk driving 14 times in the past, he handed down a 15 year prison sentence. Caporal has had a valid drivers license for 34 years, also had his license revoked for 33 years. Carporal's attorney managed to arrange a plea deal with the district attorney, however, Judge Cashman believed that the defendant would not get enough prison time if he approved the deal. Instead of going to prison for two to five years as originally arranged, Caporal will stay in prison until he is over 70 years old.Caporal's most recent drunk driving conviction came in 2009, when he nearly drove his vehicle into a house. Because of Caporal's habitual status, he could have been sent to prison for life. Instead, Judge Cashman opted to send Caporal to prison for 15 years. It is not clear if Caporal has ever caused any physical injuries, but he has been fined, jailed and had his license revoked on numerous occasions.
Drunk driving is an offense that is punished in varying degrees. Most first time offenders are able to avoid jail time, however, for each subsequent charge they risk losing their licenses for an extended period of time. Judge Cashman believes that Caporal poses a serious risk to other motorists. In order to prevent Caporal from killing or maiming another driver, he has been remanded to the Allegheny County Jail. Caporal will soon be transferred to state prison.
