In extreme cases, amnesty will be granted to immigrants to the United States if they are escaping religious or political persecution. For all other immigrants, either a work visa, student visa or visitation visa must be awarded before they will be granted entry to the US. In order to become a naturalized citizen of the US, immigrants will have to pay an immigration lawyer to assist with the process and pay all fees required. Some alien residents can become US citizens by marrying a native of the United States, however, immigration officials are particularly mindful of the growing number of cases that have resulted from the abuse of this policy. For this reason, newly married couples made up of a natural US citizen and an immigrant will be heavily scrutinized in order to establish its legitimacy. Babies born on US soil are automatically granted citizenship, but the parents of these children will not get the same benefits. A few landmark cases have upheld this standard, which has caused some parents to make the choice between returning to their native countries with their children or leaving them behind.

Most resident aliens are first awarded work visas. After living in the US for a predetermined period of time, immigrants can begin to go through the process of becoming citizens. In order to be considered, immigrants have to be able to show that they can understand and write basic English. In addition, when they file for citizenship they must live in the same jurisdiction or branch of the U.S. Citizenship and Immigration Services that they filed in. Next, applicants will need to demonstrate that they understand both US history as well as the political process. For the most part, these skills are demonstrated within a classroom setting along with dozens of other immigrants applying for citizenship. Immigrants applying for US citizenship must not be arrested or associate with immoral persons. While it is obvious that a person can avoid being arrested by obeying the law, it is not always clear what it means to be of 'good moral character.' Traditionally, immigrants frequently move into established neighborhoods filled with people from their native countries. This makes the transition process and assimilation to US culture much more easy.

The immigration process can go on for as long as two to three years before applicants are able to find out whether or not their applications successfully accepted. Even after US citizenship is granted, new citizens will need to prove that they have truthfully answered all questions on their applications and continue to live a similar lifestyle. Sometimes immigration officers will make impromptu visits to the homes and places of employment of new citizens in order to see if they are being consistent.
